3.2. Legal conditions
At Universität Hamburg, the Export and Custom Control Unit and the Legal Unit provide expert consultations. Use them as early as possible.

Established legal framework
- As a general rule, you must not violate any applicable laws of the Federal Republic of Germany in the course of your cooperation.
- Export control regulations and the related sanctions regimes are complex sets of rules whose scope also extends to university activities. Violating these regulations can result in severe penalties.
- The Nagoya Protocol and the EU basic regulations for the implementation of such, with the force of law in Germany, have to be observed.
- Take note of the sanctions lists: Individuals and institutions whom you cooperate with must not be on sanctions lists of the Federal Republic of Germany or the EU. In addition, various US sanctions lists may apply depending on the circumstances.
- Follow the guidelines and contractual agreements that belong to the cooperation. These must not contradict applicable law.
- Find out whether extraterritorial laws apply to you and your cooperation through your cooperation partners.
- Observe the applicable law of the country and institution of your cooperation partner. However, universal values, ethical principles, and good academic practice should not be compromised.
Other relevant frameworks
- We also recommend having knowledge of the US Department of Commerce’s Entity List. Collaborating with institutions and individuals on the list may have negative diplomatic consequences (e.g., denial of entry to the US; exclusion from cooperations with US involvement) for Universität Hamburg, for you as an individual, and for other parties involved in the cooperation.
- Ensure that your research and research results do not contribute to and are not used for military technology or technology that violates human rights.
Reviewing sanctions lists
In the context of international cooperation, sanctions lists must also be observed. For this purpose, there is software that enables you to check. Since the sanctions list software cannot be accessed via a saveable link, contact zoll"AT"uni-hamburg.de. The Export and Custom Control Unit then forwards you an email with access to the sanctions list software. This email also includes an explanatory video on how to use it.
