Acting professorships
The appointment of regular professors via job advertisement and academic search is regulated by the HmbHG. Pursuant to Section 14 subsection 6 HmbHG, regulations on job ads and academic searches shall not apply when persons are assigned professorial tasks temporarily before the appointment has been finalized (i.e., acting professorships). This explains why acting professorships stipulate a permanent C or W post.
Acting professorships have become firmly established throughout Germany. The Standing Conference of the Ministers of Education and Cultural Affairs of the Länder in the Federal Republic of Germany (KMK) provides recommendations for acting professorships:

Acting professorships are created to temporarily fill vacancies due to the incumbent’s appointment to another university, retirement, or death before or after completion of the procedure pursuant to Section 14 HmbHG. The same applies when the incumbent is on leave of absence without pay. Employment contracts provided by Universität Hamburg comply with this recommendation and are agreed with the human resources department of the Free and Hanseatic City of Hamburg.
This position confers employee status. If necessary, a pre-existing civil servant contract at another university may be maintained by taking a leave of absence with discontinued emoluments.
